1. Acceptance of these terms
By visiting Everlyst, creating an account, using a document builder, purchasing a plan, or otherwise using the service, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
2. Eligibility
You must be legally able to enter into a binding agreement and use the service for lawful purposes. Everlyst’s initial document experience is intended for adults preparing Alberta estate-planning documents.
3. Everlyst is not a law firm
Everlyst provides self-serve document-preparation technology. It does not provide legal, tax, financial, medical, or other professional advice, and using the service does not create a lawyer-client relationship. Read the Legal Disclaimer before relying on any document or information.
4. Member accounts
You are responsible for providing accurate account information, maintaining the security of your sign-in credentials, and promptly notifying Everlyst of suspected unauthorized use. You may not share credentials or use another person’s account. Actions taken through your authenticated account may be treated as authorized by you until we are notified otherwise.
5. Free trial
A new eligible account receives one seven-day trial of the Will builder without payment details. The trial does not include printing, downloading, or document export. The trial is limited to one use per normalized email. Deleting and recreating an account does not create a new trial.
6. Plans and payment
Essential, Complete, and Couples are one-time plans at the price displayed when you begin checkout. Applicable taxes and the final total are shown in Wix-hosted checkout. Wix and a Wix-supported payment provider collect payment details and create the authoritative plan order. Everlyst does not store your full card number.
A successful browser return from checkout does not by itself activate access. Everlyst verifies the relevant Wix order and derives your access on the server.
7. Plan access and upgrades
Essential includes the Will builder. Complete includes the Will, Personal Directive, and Enduring Power of Attorney builders. Couples provides Complete-level access to the purchaser and one eligible partner through separate accounts.
When an eligible upgrade is offered, the price is intended to equal the target plan’s current value less the full value already owned. Available purchases are determined from your current effective access. Downgrades are not offered through the application.
8. Couples access
The purchaser must provide a valid partner email that is different from the purchaser’s email and may invite only one partner under the plan. The partner must create or use their own account. Each member owns and controls their own drafts. Partners may not impersonate each other or access each other’s account, documents, or credentials.
9. Your document information
You retain your rights in information you enter. You grant Everlyst and its service providers the limited permission needed to host, process, validate, secure, back up, and generate documents from that information to operate the service.
You are responsible for the accuracy, completeness, legality, and appropriateness of your information and for reviewing generated documents before use.
10. Export and use of documents
Document export requires an active paid entitlement that includes the requested document. You are responsible for reviewing the document and following all applicable signing, witnessing, storage, and use requirements. Everlyst does not guarantee that a document will be appropriate, enforceable, or accepted in every circumstance.
11. Refunds, cancellations, and access changes
Refunds and cancellations, if available, are handled according to the purchase terms shown at checkout, applicable law, and the policies of Wix or the payment provider. If an order is refunded, canceled, reversed, or found invalid, Everlyst may recalculate access from the member’s remaining valid orders and reduce or end access accordingly.
12. Acceptable use
You must not:
- use Everlyst for unlawful, fraudulent, abusive, or deceptive activity;
- access or attempt to access another person’s account or documents;
- circumvent plan, trial, authentication, export, or security controls;
- probe, disrupt, overload, reverse engineer, or damage the service;
- upload malicious code or content that infringes another person’s rights; or
- resell, copy, scrape, or commercially exploit the service except as permitted in writing.
13. Everlyst content and intellectual property
Everlyst and its licensors own the service, software, interface, branding, question flows, explanations, and other platform content, excluding information you provide. These terms give you a limited, personal, non-exclusive, non-transferable right to use the service for its intended purpose while your access remains valid.
14. Third-party services
Everlyst relies on third-party services, including Wix, authentication, hosting, payment, communication, and analytics providers. Their terms and privacy practices may also apply to their services. Everlyst is not responsible for third-party sites or services outside its control.
15. Availability and changes
We may maintain, update, add, remove, suspend, or discontinue features. We do not promise uninterrupted or error-free operation. Where reasonably practical, we will try to provide notice of changes that materially affect paid access.
16. Disclaimers
To the extent permitted by law, Everlyst is provided on an “as is” and “as available” basis without warranties of accuracy, completeness, fitness for a particular purpose, merchantability, non-infringement, availability, or legal result. Nothing in these terms excludes a warranty or right that cannot lawfully be excluded.
17. Limitation of liability
To the extent permitted by law, Everlyst and its owners, personnel, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for lost data, profits, opportunities, or savings arising from the service. Any liability that cannot be excluded will be limited to the extent permitted by applicable law. Consumer rights that cannot lawfully be limited remain unaffected.
18. Suspension and termination
We may restrict or suspend access where reasonably necessary to protect users or the service, investigate suspected misuse, enforce these terms, respond to an invalid or canceled order, or comply with law. You may stop using Everlyst and request account closure, subject to retention allowed or required by the Privacy Policy.
19. Governing law
These terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The courts of Alberta will have jurisdiction, except where applicable law requires otherwise.
20. Changes to these terms
We may update these terms as the service or legal requirements change. The effective date identifies the current version. If a change materially affects your use, we may provide additional notice through the service or by email.
